1. Introduction

• This Privacy Policy ("Privacy Policy") describes how Loonshots Network Private Limited operating under the brand name "FPV Labs" (collectively, "FPV Labs", "we", "us", or "our") collects, uses, stores, processes, discloses, transfers, and otherwise handles personal information and other data in connection with the Stera platform and related services.
• The Stera platform is a full-stack multimodal data collection and embodied AI infrastructure solution that enables users to capture, upload, process, evaluate, manage, visualise, store, and export multimodal datasets and related outputs through mobile applications, cloud infrastructure, APIs, processing pipelines, evaluation tooling, storage systems, and associated services (collectively, the "Platform" or "Services").
• This Privacy Policy applies to your access to and use of the Platform, including the mobile application, website, developer tools, software development kits, cloud infrastructure, APIs, dashboards, and all associated products and services made available by FPV Labs.
• By downloading the application, creating an account, accessing the Services, uploading data, or otherwise interacting with the Platform in any manner, you acknowledge that you have read and understood this Privacy Policy. Where consent is required under applicable law for specific processing activities, FPV Labs will obtain such consent in accordance with applicable law. If you do not agree with this Privacy Policy, you must discontinue use of the Services immediately.
• Please note that this Policy may be updated or amended from time to time to reflect changes in our practices, legal obligations, or applicable regulations. Your continued use of the Services following such changes will constitute your acknowledgement and acceptance of the revised Policy.
• If you access or use the Services on behalf of an organisation, institution, or other legal entity, you represent and warrant that you are authorised to accept this Privacy Policy on behalf of such entity, and references to "you" shall include both you individually and such entity, where applicable.

2. Definitions

• "Personal Data" means any information relating to an identified or identifiable natural person that is collected, stored, processed, transmitted, generated, or otherwise handled by FPV Labs in connection with the Platform or the Services, and includes any information that constitutes "personal data", "personal information", or a similar term under applicable data protection laws. Personal Data does not include information that has been irreversibly anonymised or de-identified such that an individual can no longer reasonably be identified.
• "User Data" means any data, content, recordings, files, media, prompts, inputs, outputs, datasets, annotations, metadata, configurations, or other materials uploaded, submitted, transmitted, captured, generated, processed, stored, or otherwise made available by or on behalf of a user through the Platform or the Services. In relation to such Personal Data contained within User Data, the User uploading or controlling the relevant User Data acts as the data fiduciary, controller, or equivalent responsible entity, and FPV Labs acts solely as a data processor processing such information on behalf of and in accordance with the instructions of the relevant User, applicable contractual terms, and applicable law. FPV Labs does not independently determine the purpose or means of processing Personal Data contained within User Data except where required for security, legal compliance, fraud prevention, abuse monitoring, service improvement using de-identified information, or other legitimate operational purposes described in this Policy.

3. Scope and Applicability

• This Privacy Policy applies to all individuals who access, use, or interact with our Services, regardless of their geographical location.
• If you are accessing or using our Services from outside India or from within India, you acknowledge and agree as follows:
  • your Personal Data, including sensitive personal data, may be transferred to, stored in, and processed within India. By using our Services, you acknowledge and consent to such transfer and processing in accordance with this Policy.
  • we shall transfer Personal Data outside India only to such countries or territories as may be notified and permitted by the Central Government under Section 16 of the Digital Personal Data Protection Act, 2023 ("DPDP Act").
  • you must not upload Personal Data of third parties to the Services without having obtained all legally required consents and notices from those individuals. You are responsible for ensuring that any Personal Data you upload was collected lawfully and may be transferred to FPV Labs for processing under applicable law.
  • Indian data protection laws, including the DPDP Act may differ in scope, rights, and obligations from the data protection or privacy laws applicable in your home jurisdiction. By using our Services, you expressly acknowledge this and agree that your Personal Data will be processed in accordance with Indian law.
• Irrespective of your location, you retain the rights afforded to you under the DPDP Act, the Information Technology Act, 2000 ("IT Act"), the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules").
• Where applicable under relevant data protection laws, FPV Labs may act as a processor/service provider on behalf of enterprise or organisational users, and such users remain responsible for providing legally required notices, obtaining consents, and establishing lawful bases for processing Personal Data submitted through the Services.
• This Policy does not apply to (i) publicly available Personal Data (ii) Personal Data processed by or on behalf of the State for legitimate purposes under applicable law.

4. Information We Collect

We may collect Personal Data, technical information, usage information, multimodal recording data, and other data relating to your access to and use of the Service. Such information may be collected directly from you, automatically through your use of the Service, or through integrations, devices, APIs, SDKs, and related technologies.

4.1 Information Collected Directly From You

The following categories of Personal Data are collected directly from you when you register, subscribe, or otherwise interact with or avail our Services. Such data is collected on the basis of your free, specific, informed, unconditional, and unambiguous consent as required under the applicable data protection laws:

• identifiers and account information, including but not limited to your full legal name, email address, mobile phone number, date of birth, residential or delivery address, and account credentials such as username and password, where you choose to register with us;
• information, files, prompts, recordings, datasets, images, videos, audio, metadata, and other content that you upload, submit, transmit, generate, or otherwise make available through the Service;
• account registration and profile details, including role, permissions, and preferences;
• authentication credentials, which may be stored in hashed or encrypted form where applicable;
• billing, payment, subscription, and transaction-related information processed directly by us or through authorised third-party payment service providers;
• communications with us, including enquiries and correspondence via email, support channels, meetings, or contact forms, and the content of such communications.

4.2 Multimodal Recording and Sensor Data

In connection with the operation of the Service, we may collect, process, store, and generate multimodal recording and sensor data captured through supported devices and integrations, including:

• video recordings, image frames, audio inputs, and related media;
• depth, spatial, environmental, and sensor-derived information;
• inertial measurement unit (IMU) readings, synchronization metadata, timestamps, calibration information, and device identifiers necessary for recording coordination and processing;
• processed outputs and annotations generated through the Service, including pose estimations, tracking outputs, scene reconstructions, meshes, simulation exports, validation outputs, and related derived data; and
• quality assurance, evaluation, validation, and benchmarking metrics associated with recordings, datasets, and processing workflows.

Certain recordings, pose estimations, spatial mappings, body tracking outputs, facial geometry, movement patterns, and related multimodal data processed through the Services may constitute biometric or sensitive personal data under applicable law. Users are solely responsible for obtaining all legally required notices, consents, permissions, and authorisations prior to collecting or uploading such data.

4.3 Automatically Collected Information

When you access or use the Services, we may automatically collect certain technical, diagnostic, operational, and usage-related information through server logs, cookies, APIs, SDKs, analytics tools, telemetry systems, and similar technologies, including:

• IP addresses, browser type, device identifiers, operating system information, configuration settings, and network information;
• session activity, feature usage, dashboard interactions, navigation patterns, timestamps, request metadata, and usage analytics;
• crash reports, error logs, diagnostics, telemetry data, performance metrics, reliability data, and operational logs;
• approximate location information derived from IP addresses, device settings, or network information; and
• cookie data and similar tracking or session technologies used to authenticate users, maintain sessions, analyse usage, improve functionality, monitor performance, and secure the Service.

4.4 Information From Third Parties

We may receive information relating to you from third-party service providers, enterprise administrators, authentication providers, payment processors, cloud infrastructure providers, analytics providers, integrations, or other authorised third parties in connection with the operation, administration, security, billing, support, or improvement of the Service.

4.5 Aggregated and De-identified Information

We may generate aggregated, anonymised, or de-identified information derived from the operation and use of the Service for analytics, benchmarking, security, operational improvement, infrastructure optimisation, research, and product development purposes, provided that such information does not reasonably identify you or any individual.

5. Purpose of Collection

We use the information we collect for the following purposes:

Depending on the applicable jurisdiction and context of processing, FPV Labs processes Personal Data on the basis of consent, performance of a contract, compliance with legal obligations, legitimate interests, fraud prevention, security, service delivery, or other lawful grounds permitted under applicable law.

6. AI Model Training and User Data

• FPV Labs does not sell private User Data to third parties.
• FPV Labs may use data, feedback signals, usage information, prompts, recordings, annotations, outputs, telemetry, and related materials submitted through or generated by the Services for service delivery, security, abuse prevention, analytics, research, operational monitoring, infrastructure optimisation, and product improvement purposes, subject to applicable law and the applicable Terms of Service, subscription plan, enterprise agreement, or order form governing your use of the Services.
• The extent to which User Data may be used for training, fine-tuning, benchmarking, evaluation, or improvement of FPV Labs' artificial intelligence, machine learning, multimodal processing, robotics, or related systems depends on the applicable service tier, commercial arrangement, and Terms governing the relevant Services.
• Additional restrictions, commitments, or controls relating to model training, retention, deletion, or enterprise data handling may apply under applicable Paid Plans, enterprise agreements, or order forms.
• We may generate and use aggregated, anonymised, de-identified, statistical, operational, diagnostic, telemetry, and related information derived from the use and operation of the Services for analytics, security, reliability, infrastructure optimisation, abuse prevention, research, and service improvement purposes, provided such information does not reasonably identify you or any individual. Enterprise and paid-tier customers may separately opt in to permit broader model training, benchmarking, dataset generation, or research usage pursuant to an applicable order form, enterprise agreement, or written consent.

7. Disclosure of Your Personal Data

We do not sell your Personal Data. We may preserve, access, review, monitor, or disclose information where we reasonably believe such action is necessary to detect, prevent, investigate, mitigate, or address fraud, abuse, security incidents, illegal activity, threats to safety, violations of our terms, or technical or operational issues affecting the Services.

We may share information only in the following circumstances:

• We retain your Personal Data only for as long as is reasonably necessary to fulfil the purposes for which we have collected and processed your Personal Data, and to perform the Services, or for other legitimate purposes, unless a longer retention period is required or permitted under applicable law.
• Where the Personal Data collected is no longer required by us, we will perform the necessary procedures for securely destroying, deleting, erasing, or converting it into an anonymous form as permitted or required under applicable laws.
• Notwithstanding the foregoing, we may retain and use Personal Data to the extent necessary to: (a) comply with applicable legal obligations; (b) respond to lawful requests from governmental or regulatory authorities; (c) resolve disputes; (d) enforce our agreements, policies, or terms; or (e) establish, exercise, or defend legal claims.
• If you end the subscription of the Services, or if your account is deactivated or deleted, or if you request us to erase your Personal Data, we will delete or anonymize your Personal Data in accordance with this Policy, unless retention is required or permitted under applicable law or necessary for legitimate business purposes.
• Your recording data, processed outputs, and associated metadata are retained according to the following schedule:
  • Free Tier: Thirty (30) days after the date of upload. After this period, recordings and all associated processed outputs are automatically and permanently deleted from our systems.
  • Paid Tier: Recordings are retained for the duration of your active subscription, plus ninety (90) days after subscription termination. After this period, recordings and associated outputs are automatically and permanently deleted.
  • Enterprise/Bring Your Own Bucket: Retention of the data is determined by your storage configuration and is the responsibility of the customer.
• We may retain your Personal Data and related logs for a period of one (1) year for the purposes of detecting unauthorised access, investigating security incidents, undertaking remediation measures, preventing recurrence, and enabling continued processing in connection with any such compromise or security event.
• You may manually delete your recordings at any time through the dashboard. Deletion requests are processed within 30 days. We do not retain deleted data for model training or any other purpose following confirmed deletion. Notwithstanding deletion requests, residual copies of Personal Data may temporarily remain in backups, archives, logs, disaster recovery systems, security systems, or operational records maintained in the ordinary course of business, after which such information will be securely deleted or anonymised in accordance with applicable retention cycles.

9. Data Security

We implement reasonable technical and organisational measures designed to protect Personal Data and User Data against unauthorised access, accidental loss, alteration, disclosure or destruction. These include encryption in transit and at rest for sensitive fields, role-based access controls, audit logging, vulnerability management and personnel training. No method of transmission over the internet or method of electronic storage is, however, completely secure, and we cannot guarantee absolute security. FPV Labs does not guarantee that the Services will be free from unauthorised access, cyberattacks, data loss, or other security incidents.

In the event of a Personal Data breach affecting your Personal Data, we will notify you and the relevant regulator (including the Data Protection Board of India, where applicable) within the timeframes required by law. You are responsible for keeping your account credentials confidential and for promptly notifying us of any suspected unauthorised access to your account.

10. Your Rights

• Right to access information: You may request access to information relating to the Personal Data processed by us, including details regarding the nature of such Personal Data, the purposes for which it is processed, and other information. This right applies only to Personal Data processed by us in our capacity as a data fiduciary, as applicable.
• Right to correction and erasure of Personal Data: You have the right to request correction, updating, completion, or rectification of inaccurate or incomplete Personal Data maintained by us. Upon receipt of such request, we will take reasonable steps to erase or anonymise the relevant Personal Data unless continued retention is required for compliance with applicable law, regulatory obligations, dispute resolution, security purposes, fraud prevention, enforcement of legal rights, or other lawful purposes. Where Personal Data has been incorporated into backups, system logs, disaster recovery systems, derived datasets, analytics systems, machine learning workflows, or other technical or operational records, complete deletion may not always be immediately feasible. In such circumstances, we will implement reasonable measures to restrict further processing, anonymise, or otherwise protect such Personal Data in accordance with applicable law.
• Right to withdraw consent: Where processing of your Personal Data is based on consent, you may withdraw such consent at any time by contacting us. Upon withdrawal of consent, we will cease processing the relevant Personal Data unless continued processing is permitted or required under applicable law. Withdrawal of consent shall not affect the lawfulness of any processing carried out prior to such withdrawal. You acknowledge that withdrawal of consent may limit, suspend, or prevent our ability to provide certain features, functionalities, or Services where such processing is necessary for operation of the Platform or performance of contractual obligations.
• Right to Grievance Redressal: You have the right to access reasonable and readily available grievance redressal mechanisms in relation to any concerns, complaints, acts, or omissions relating to the processing of your Personal Data or the exercise of your rights under applicable data protection laws.
• Right to approach the Data Protection Board of India: If you are dissatisfied with the resolution of a grievance submitted to us, you may approach the Data Protection Board of India in accordance with the applicable data protection laws thereunder. Before approaching the Data Protection Board, you are required to first provide us with a reasonable opportunity to address your grievance through our designated grievance redressal mechanism.
• Right to nominate: You have the right to nominate another individual who may, in the event of your death or incapacity, exercise your rights in relation to your Personal Data in accordance with applicable law.

Where FPV Labs processes Personal Data solely on behalf of an enterprise customer or other data controller, requests relating to access, correction, deletion, objection, portability, or other data subject rights may be redirected to the relevant customer responsible for such Personal Data.

Certain jurisdictions may provide additional privacy rights relating to access, correction, deletion, portability, restriction, objection, or withdrawal of consent. FPV Labs will honour such rights to the extent required under applicable law.

11. Automated Processing and AI Outputs

The Services may use automated systems, machine-learning models, computer vision systems, pose estimation tools, annotation systems, and related AI technologies to generate Outputs, labels, recommendations, validation metrics, and related information. Such Outputs may be probabilistic, incomplete, inaccurate, or unsuitable for particular use cases. Users remain solely responsible for reviewing, validating, and determining the appropriateness of all Outputs prior to reliance or downstream use.

12. Your Duties

You agree and undertake to:

• comply with all applicable laws, regulations, and legal requirements in connection with your use of the Services and exercise of your rights under this Privacy Policy;
• provide accurate, complete, and authentic Personal Data and not impersonate any other individual while interacting with the Services;
• ensure that any request for correction, update, or erasure of Personal Data is based on information that is accurate, lawful, and verifiably authentic.

13. Data Breach Notification

Upon becoming aware of any Personal Data breach affecting Personal Data processed by us, FPV Labs shall, without undue delay and within the timelines required under applicable law:

• notify affected Users in clear and plain language; and
• provide relevant information regarding the nature of the breach, the categories of Personal Data affected, the likely consequences of the breach, the mitigation or remedial measures taken or proposed by FPV Labs, and any reasonable protective measures that affected Users may take.

14. Communication

By accessing or using the Services, you consent to receiving communications from FPV Labs through electronic means, including email, in-platform notifications, text messages, or other digital channels. Such communications may include account notifications, security alerts, operational updates, technical notices, support-related communications, billing information, and, where permitted under applicable law, marketing or promotional communications.

You may opt out of receiving marketing or promotional communications at any time by using the unsubscribe mechanism included in such communications or by contacting FPV Labs at [email protected].

15. Children's Privacy

• The Service is not directed to Users under the age of eighteen (18). We do not knowingly collect Personal Data from children.
• Where Users upload recordings that contain identifiable images, voices, or other Personal Data of children, the User represents and warrants that they have obtained verifiable parental or guardian consent as required under applicable law (including Section 9 of the DPDP Act) prior to such upload. FPV Labs may, in its sole discretion, decline to process or store recordings where it has reasonable grounds to believe that required consents have not been obtained. If we become aware that we have inadvertently collected data from a child under eighteen (18), we will take steps to delete that information promptly.

Users may not knowingly upload recordings or Personal Data relating to children unless they have obtained all legally required parental or guardian consents and authorisations under applicable law. If you believe we have collected data from a minor, please contact us at [email protected].

16. Cookies and Tracking Technologies

• FPV Labs uses cookies, SDKs, pixels, local storage, analytics technologies, session technologies, and similar tracking mechanisms for authentication, security, fraud prevention, session management, analytics, feature optimisation, operational monitoring, performance improvement, and service functionality. Certain third-party analytics or infrastructure providers may also place cookies or similar technologies in connection with operation of the Services.
• The Platform does not currently respond to browser-based "Do Not Track" signals or similar mechanisms where no uniform industry standard exists.
